Arbitration has been used in commercial disputes for many years but family arbitration is now a recognised form of dispute resolution for separating couples as well.

What is it?

Rather than going to court, the couple jointly appoint an arbitrator, often a senior lawyer or retired judge, to hear the evidence and adjudicate. They agree to be bound by the arbitrator’s decision. The process takes place outside of court, is private, and can be dealt with when convenient to the couple.

What are the benefits?

Family arbitration offers several benefits including: flexibility; the ability to choose an expert in their field; and the fact that the process can deal with as many issues as the couple require. The arbitrator’s fees need to be met but the process can be tailored to the couple’s needs, thereby saving costs. 

Is it for me?

Arbitration can also be used to resolve many family disputes, even if court proceedings have already been commenced.
