Property investors

Property is an ever-popular asset class. The ride can get bumpy, but property never really goes out of fashion. Bricks and mortar – just as likely steel and glass – have the attraction of a tangible asset with an underlying value and the potential to produce an income.

With the UK property market firmly split into ‘prime’ and ‘secondary’, well advised investors are increasingly looking at opportunities to increase the value of more secondary assets through pro-active management, re-gearing leases and encouraging their tenants to commit to premises for the longer term.
Of course, owning property is not without its downside. Tenant default and empty rates problems can soon transform a property producing a tidy sum to a net liability and wreck the capital value of your portfolio.

Our considerable experience extends to all of the legal issues around buying, leasing and selling commercial property investments. We will be with you all the way to ensure the right balance is struck between keeping your assets producing income and their future marketability.

Case studies

 Property sale

Our client owned several educational campuses and had agreed a merger with another college. One of the campuses needed to be sold before the merger due to the debt secured on the property. The Department of Education (DoE) purchased the campus. We had to simultaneously complete the transfer to the DoE, pay off the debt to the bank and complete the merger.

The sale to the DoE did not provide enough funds to repay the lending, so funds were incoming from other sources. The entire deal had to complete at one minute past midnight with a complex multi-party undertaking. Everything was set up electronically so that the matter completed during the night whilst everyone was asleep.

Property acquisition

Our client was seeking to acquire an office building located in a large town in Buckinghamshire. he site was subject to Restrictive Covenants protecting the surrounding area for commercial use until the central area had been fully developed and sold on. The client relied on us for technical advice on the enforceability of the Restrictive Covenants and actions which could be taken including successfully obtaining insurance.
